Festus Onyia (Partner), Titilola Olatunde-Fasogbon (Senior Associate), and Michael Ugah (Senior Associate) of Udo Udoma & Belo-Osagie’s Dispute Resolution team have contributed the Nigerian chapter to the 2025 edition of The Middle Eastern and African Arbitration Review, published by Global Arbitration Review (GAR).
In our contribution, we analyse three significant decisions from Nigerian appellate courts that impact arbitration practice. We examine how the Supreme Court ruled that High Court jurisdiction for arbitral award enforcement isn’t limited by subject matter jurisdiction, a departure from previous jurisprudence.
We also discuss cases clarifying when disputes are genuine enough for arbitration and when inconsistent dispute resolution clauses can prevent arbitration proceedings.
