Uzoma Azikiwe, SAN (Partner), Festus Onyia (Partner), and Michael Ugah (Associate) of the firm’s dispute resolution team, have contributed the Nigerian chapter to the 2022 edition of The Middle Eastern and African Arbitration Review (GAR). The publication is now live; to read it, please click here: https://globalarbitrationreview.com/review/the-middle-eastern-and-african-arbitration-review/2022/article/nigeria.
The publication addresses topical issues such as whether a decision of an arbitral tribunal awarding a relief that is contingent upon the fulfilment, on a future date, of a condition affects the finality or validity of the award and whether the existence of an arbitration clause in a contract ousts the jurisdiction of the court. The publication also highlights an important policy statement by Nigeria’s highest court, the Supreme Court, deprecating the unfortunate trend whereby award debtors mount all kinds of, mostly frivolous and unsubstantiated, challenges to arbitral awards.
