Uzoma Azikiwe, SAN (Partner), Festus Onyia (Partner), and Michael Ugah (Senior Associate) of the firm’s dispute resolution team have contributed the Nigerian chapter to the 2023 edition of The Middle Eastern and African Arbitration Review. The publication discusses topical issues relating to arbitration, such as whether: (a) an admitted but unpaid debt amounts to a dispute that can be referred to arbitration; (b) filing a defence under the summary judgment or undefended list procedure amounts to taking a step in the matter that would disentitle a party from applying for a stay of proceedings and referral of the dispute to arbitration; and (c) a court should order a stay of proceedings pending arbitration where, having regard to the limitation period that applies to award enforcement, it would be impossible to enforce any aware that will result from the arbitration.
